Agreement
These terms are an agreement between you and [Legal entity name], [registered address] ("we", "us"). They apply when you use the bramtide app and bramtide.com (together, "bramtide"). By using bramtide, you agree to these terms and to our Privacy Policy.
Who can use bramtide
You must be at least 16 years old, or the minimum age for digital services in your country if that is higher.
Not a medical service
bramtide helps you notice and reflect on your social energy. It is not a medical device and does not diagnose, treat or prevent any condition. It is not a substitute for professional advice.
If you are struggling or in crisis, please contact a professional or your local emergency services.
Your account and friends
Some features, such as sharing your status with friends, need an account created with Sign in with Apple. You are responsible for activity on your account.
Only connect with people you want to share with. You can hide your status from anyone or remove connections at any time.
Using bramtide well
Don't:
- misuse bramtide or try to access it in ways we don't provide,
- harass other people through it,
- impersonate anyone,
- interfere with its security,
- use it to break the law.
We may suspend accounts that do.
bramtide Plus subscriptions
bramtide is free to start. bramtide Plus is an optional auto-renewing subscription that unlocks extra features. The price and length of each subscription are shown in the app before you buy.
- Payment: payment is charged to your Apple ID account when you confirm the purchase.
- Automatic renewal: your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
- Renewal charge: your account is charged for renewal within 24 hours before the end of the current period, at the then-current price.
- Managing and cancelling: you can manage or cancel your subscription in your Apple ID account settings (Settings › [your name] › Subscriptions). Cancelling stops future renewals. You keep access until the end of the period you've paid for.
- Free trials: if a free trial is offered, any unused part of it ends when you buy a subscription.
- Refunds: payments are processed by Apple, and refunds are handled by Apple under its policies (reportaproblem.apple.com). This does not affect any rights you have under the law of your country.
- Price changes: if the price changes, Apple will let you know in advance, and where required, ask for your consent.
Waitlist and founding perks
Joining the waitlist is free and doesn't oblige you to anything. Any founding-member perks will be described when they are offered. They are personal, can't be exchanged for money, and may be limited in number or time.
Our content
bramtide, Bram, our logos, illustrations, text and software belong to us or our licensors. We give you a personal, non-transferable licence to use the app for your own, non-commercial use. Your content stays yours.
Apple
These terms are between you and us, not Apple. Apple is not responsible for bramtide or its content. Your use of the app must also follow the Apple Media Services Terms and Conditions. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
Disclaimers
We work hard to make bramtide reliable, but it is provided "as is". Patterns and forecasts in the app are estimates based on your own entries and may not always be accurate. Nothing in these terms limits rights you have as a consumer that cannot be limited by law.
Liability
To the extent the law allows, we are not liable for indirect or consequential losses. Our total liability is limited to the amount you paid us for bramtide in the 12 months before the claim. Nothing limits liability for death or personal injury caused by negligence, for fraud, or anything else that cannot be limited by law.
Ending use
You can stop using bramtide and delete your account in the app at any time. We may end or suspend access if you seriously or repeatedly break these terms. Deleting the app does not cancel a subscription. Please cancel it in your Apple ID settings.
Changes
We may update these terms. If a change is significant, we'll tell you in advance in the app or by email. If you keep using bramtide after a change takes effect, you accept the updated terms.
Governing law
These terms are governed by the laws of [the Netherlands]. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.
